Terms of Use

1. What Sorceress does

Sorceress is a sourcing tool for interior designers. You give it a photo, a link or a description of a piece. Sorceress uses AI to identify the piece, searches a number of third-party marketplaces for similar listings, and shows the results in one place. Each result links to the original listing on the marketplace where it was found.

Sorceress is not a marketplace and not a seller. We don't sell, own or hold any of the items shown. We don't take payments, run checkout, arrange shipping or handle returns. If you buy something, you buy it on the marketplace's own site, from the seller, under that marketplace's terms. We are not a party to that transaction.

2. Third-party marketplaces and listings

Listings, photos, prices, descriptions and availability come from third-party marketplaces and their sellers. We don't create, check or endorse them, and we don't control those sites. In particular:

• A listing may be inaccurate, incomplete, out of date, already sold or removed by the time you see it. Always check the details on the original listing before you buy.
• Questions about an item, its condition, authenticity, shipping or a purchase belong with the seller or the marketplace.
• Your use of a marketplace is governed by that marketplace's own terms and privacy policy, not ours.

We make no warranty about any third-party listing, item or seller, including its description, condition, authenticity, attribution, provenance, dimensions, price or availability.

3. AI identification and rankings are estimates

Sorceress uses AI models to describe what is in your photo and to rank results. The identification (for example a style, era, maker or material), match scores, the “reproduction” flag and any “deal” label are automated estimates. They can be wrong. They are not an appraisal, an authentication or professional advice, and you shouldn't rely on them as one.

4. Etsy

Some results may come from Etsy through Etsy's API. The term 'Etsy' is a trademark of Etsy, Inc. This Application uses Etsy's API, but is not endorsed or certified by Etsy.

DISCLAIMER: THIS APPLICATION IS SOLELY PROVIDED BY TERRASSE STUDIO LLC (THE “APPLICATION DEVELOPER”). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.

5. The beta

Sorceress is in beta. Features will change, some may be removed, and the Service may sometimes be slow or unavailable. We may set usage limits (for example the number of searches per month); the limits that apply to you are shown in the app.

We don't charge for the beta. If we ever introduce paid plans, we'll tell you in advance, and you won't be charged unless you choose a paid plan.

6. Your account

• You must be at least 18 years old to create an account.
• Give accurate information and keep it up to date.
• Keep your password and Google sign-in secure. You're responsible for what happens under your account. Tell us at staff@sorceress.tools if you think someone else has used it.
• One person per account. Don't share your login.

7. Your content

“Your content” is what you put into Sorceress: photos, links, descriptions, notes, Runes (project boards) and anything you save, including details about your own clients. You keep ownership of your content.

You give us permission to store, copy, process and display your content only as needed to run the Service for you, including sending it to the service providers named in the Privacy Policy (for example, sending a photo to our AI provider to identify it). We don't use your content to advertise to you or sell it to anyone.

You confirm that you have the right to upload your content and, for any client details you add, that you're allowed to store them in a tool like Sorceress.

8. Acceptable use

When you use Sorceress, you agree not to:

• break the law or anyone else's rights, including intellectual property rights;
• upload content you don't have the right to share, or that is illegal, harmful or contains malware;
• scrape, crawl or bulk-download the Service or its results, or access it by automated means other than the features we provide;
• get around usage limits, rate limits or security measures, or probe, scan or test the Service for weaknesses without our written permission;
• copy, resell, sublicense or offer the Service (or its results) as part of another product or service;
• reverse engineer the Service, except where the law allows it;
• use the Service in a way that breaks a marketplace's terms, or to harass sellers or other users;
• interfere with the Service or with other people's use of it.

9. Our property and other people's trademarks

The Sorceress software, design and brand belong to us. These terms give you a personal, non-exclusive, non-transferable right to use the Service for your own sourcing work while your account is active.

Marketplace names, logos and listing content belong to their owners. We show them only to identify where a result comes from and to link to it. Their appearance in Sorceress doesn't mean those companies endorse or are affiliated with Sorceress.

If you send us feedback or suggestions, we may use them without any obligation to you.

10. Ending your account

You can stop using Sorceress at any time. To delete your account and its data, email staff@sorceress.tools.

We may suspend or close your account if you break these terms, if your use creates a risk or legal exposure for us or others, or if we end the beta or the Service. Where it's reasonable, we'll tell you first and give you a chance to export what you need. Sections 2, 3, 4, 7 (last paragraph), 9, 11, 12, 13 and 14 continue to apply after your account ends.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY RESULT, IDENTIFICATION OR LISTING IS ACCURATE, COMPLETE OR AVAILABLE.

12. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW: (A) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITIES; (B) WE ARE NOT LIABLE FOR ANY PURCHASE YOU MAKE, OR ANY DISPUTE YOU HAVE, WITH A MARKETPLACE OR SELLER; AND (C) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND US$100. SOME JURISDICTIONS DON'T ALLOW THESE LIMITATIONS, SO THEY MAY NOT ALL APPLY TO YOU.

13. Your responsibility to us

If a third party makes a claim against us because of content you uploaded or because you broke these terms or the law, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.

14. Governing law and disputes

These terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Michigan, and you and we consent to their jurisdiction. Before filing a claim, please email us so we can try to resolve it informally.

15. Changes to these terms

We may update these terms. We'll change the “Last updated” date above, and for significant changes we'll tell you by email or in the app before they take effect. If you keep using Sorceress after a change takes effect, you accept the updated terms.
